1. Acceptance of Terms
By browsing or purchasing from this site, you agree to these Terms and all referenced policies. If you disagree, please exit now.
2. Changes to Terms
My Nguyen may update these Terms at any time by posting changes here. Continued use after updates constitutes acceptance.
3. Site Use
You may browse products, place orders, and create an account. Prohibited activities include:
- Violating laws or third-party rights
- Uploading malicious code
- Scraping or harvesting data
4. Products & Restrictions
All perfumes are alcohol- and oil-based for external use only. Read and follow all package warnings before use.
All sales are final—see our Returns & Shipping page. Products are for personal use only; resale or redistribution requires prior written consent.
5. Order, Payment & Pricing
Order confirmations do not guarantee acceptance. We may refuse or cancel orders for any reason, including availability or suspected fraud. Payments are processed via PCI-compliant gateways. Prices and promotions are subject to change without notice.
6. Intellectual Property
All site content—text, images, logos, scent names, and lore—is owned by My Nguyen or licensed. No unauthorized use or reproduction is permitted.
7. Disclaimers & Limitation of Liability
This site and all products are provided “as is” without any warranty, express or implied. To the fullest extent allowed by Texas law, My Nguyen is not liable for any indirect, incidental, special, punitive or consequential damages arising from use of this site or any products, regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
To the fullest extent permitted under Texas law, My Nguyen total liability for any claim arising out of or relating to these Terms or any products purchased hereunder shall in no event exceed the lesser of:
7.1 The total amount you paid to My Nguyen in the three (3) months immediately preceding the event giving rise to the claim; or
7.2 Seventy dollars (USD $70).
8. Indemnification
You agree to defend, indemnify, and hold harmless My Nguyen and affiliates from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your use of the site or products.
9. Dispute Resolution
9.1 Notice of Claim & Cure Period
Before initiating arbitration or any legal action, you must send a written Notice of Claim to My Nguyen at [email protected] (or such other address as posted in the “Contact Information” section). Your Notice of Claim must include:
1. Your name, address, and contact information
2. Order number(s) and purchase date(s)
3. A clear description of the nature of your complaint and the relief you seek (up to USD $70)
My Nguyen will have thirty (30) days from receipt of your Notice of Claim to investigate and attempt to resolve the dispute (“Cure Period”). If we resolve the matter to your satisfaction within the Cure Period, you agree that this completes any required dispute process.
9.2 Binding Arbitration
If we cannot resolve your claim during the Cure Period, you and My Nguyen agree that all disputes arising out of or relating to these Terms or any products purchased hereunder (including interpretation, breach, termination, or validity) shall be submitted to binding arbitration under the Commercial Arbitration Rules of the American Arbitration.
- Location: Bexar County, Texas
- Procedure: A single arbitrator, selected in accordance with the AAA rules
- Governing Law: Texas law applies, without regard to conflict-of-law principles
- Remedies: You may recover only the relief granted by the arbitrator, subject to the Liability Cap in Section 7
Both you and My Nguyen waive any right to a jury trial, and you further waive any right to participate in a class, collective, or representative action. Judgment on the arbitrator’s award may be entered in any court of competent jurisdiction.
9.3 Attorneys’ Fees and Costs
If a party initiates arbitration or legal proceedings to enforce or interpret these Terms and does not prevail, that non-prevailing party shall reimburse the prevailing party for reasonable arbitration fees and court costs incurred.
Each party will otherwise bear its own attorneys’ fees and expert fees unless the arbitrator orders otherwise under applicable rules.
10. Waiver & Assignment
No failure or delay in enforcing any right hereunder will operate as a waiver. These Terms, and any rights or obligations hereunder, may not be assigned by you without My Nguyen’s prior written consent.
11. Electronic Communications
By using the site, you consent to receive electronic communications (e.g., email) regarding your orders or updates to policies. Electronic notices are deemed received one business day after sending.
12. Force Majeure
My Nguyen is not liable for delays or failures in performance due to events beyond reasonable control, including natural disasters, acts of government, or supply-chain disruptions.
13. Governing Law & Venue
These Terms are governed by Texas law. Any arbitration or court action will take place exclusively in Bexar County, Texas.
14. Entire Agreement & Severability
This document and its referenced policies constitute the entire agreement between you and My Nguyen (perfume house name MxN PERFUME). If any provision is held invalid under Texas law, the remainder will remain in full force.
